Toutes deux dénommées ci-après « les parties » : Considérant : 1. Que la bonne gouvernance est la condition pour assurer une exploitation optimale durable des infrastructures réalisées par la puissance publique ; 2. Que l’aménagement et ses équipements sont des biens publics installés sur le domaine national et sur le domaine public de l’Etat et dont la gestion obéit à des règles spécifiques et engage leurs responsabilités ; 3. Que les aménagements et les équipements faisant l’objet de ce contrat sont propriétés de l’Etat du Sénégal, sauf stipulation contraire rendant cette clause caduque ; ils ne peuvent être vendus, ni loués, ni prêtés ; 4. Que l’union n’est qu’usufruitière et par conséquent n’a qu’un droit d’usage et de jouissance dans les conditions et la durée prévues par le présent contrat.
